Dear Andriy Borisovich!
The Public Union "NGO "National Assembly of People with Disabilities of Ukraine" informs you about the consequences of the Law of Ukraine "On Amendments to the Law of Ukraine "On Compulsory State Social Insurance" and the Law of Ukraine "On Compulsory State Pension Insurance" adopted by the Verkhovna Rada of Ukraine on September 21, 2022, No. 2620-IX.
Trade unions, employers' associations, and the public strongly opposed the adoption of the relevant law, which was submitted to the Verkhovna Rada of Ukraine in the form of a draft law (registration No. 3663) in June 2020. For some time, the Ministry of Social Policy of Ukraine (headed by Minister M. Lazebna) and the Pension Fund of Ukraine did not support the draft law.
Unfortunately, the lobbyists of the draft law, taking advantage of the public's focus on the terrible consequences of Russian aggression, "dragged" it through.
The presentation of Law No. 2620-IX made by Halyna Tretiakova, Chair of the Committee on Social Policy and Veterans' Rights, on the website of the Servant of the People political party is shocking. She states that this law "preserves, and in some cases increases, all pension and insurance payments, as well as social services that victims of industrial accidents and their families currently receive from the Social Insurance Fund of Ukraine." This is how she characterized it.
But the real truth of the implementation of this law, which came into force on January 1, 2023, was a terrible blow to the most vulnerable citizens of our country, those who lost their health and ability to work while performing their duties, those who, during their professional activities, together with their employers, filled the Compulsory State Social Insurance Fund with their corporate funds!
The beginning of this year has become a real rubicon for them between life and survival.
By grossly violating the rights of hundreds of thousands of such people from disability their deprived:
- payment for treatment in rehabilitation departments of a health resort facility after past illnesses and injuries,
- permanent third-party care, which was compensated by paying the minimum wage fees,
- household services - in the amount of half the minimum wage,
- special medical care - in the amount of a quarter of the minimum wage,
- free medicines (not on the reimbursement list),
- payments for additional food prescribed by doctors.
Leveling and ignoring the insurance nature of the funds of the Compulsory State Social Insurance Fund and, accordingly, the existing social guarantees for these people, the Law provided for the provision of social guarantees on a general basis, as well as for those who did not pay contributions in case of occupational injury, such as sanatorium treatment, provision of auxiliary and other means of rehabilitation, purchase of cars, training in driving, transportation services and compensation for gasoline, repair and maintenance of cars.
However, it is not only the lack of funds that causes people to be denied payment or the provision of what they received before this shameful law came into force.
Today, the implementation of this law is completely blocked due to the irresponsibility of the Ministry of Social Policy of Ukraine, which has not yet developed the necessary regulations.
No one pays attention to the fact that as a result, people left to their own devices during the war and with limited social guarantees are suffering and begging for help! They need it today, many of them are on the verge of life and death, they cannot wait!
We ask you, dear Andriy Borysovych, to ensure that measures are taken to immediately resolve these issues and prevent further violations of the constitutional rights of Ukrainian citizens.
Together, we must prevent critical discontent among the general population, which weakens our country in times of war!
