Legislative norms on caring for a person with a disability

On June 9, a webinar "Caring for a person with a disability on a professional and non-professional basis" was held, organized The Resource Center of the National Assembly of People with Disabilities of Ukraine (NAPWD) within the framework of project "Rehabilitation in Ukraine (Rehab4U). 

The speakers at the event were Oleg Lepetyuk, a lawyer and head of the Kharkiv Association of Blind Lawyers Oleg Lepetyuk, and Igor Shramko, a lawyer at the hotline of the All-Ukrainian Public Association National Assembly of People with Disabilities of Ukraine.

The participants of the webinar were informed in detail about the provisions of the current legislation governing the care of people with disabilities on a professional and non-professional basis, the requirements for providers of such services and the quality of their work, the procedure for processing the relevant compensation payment, and practical experience in this area. 

In particular, the requirements for professional service providers include training or medical education. Services are provided based on the results of an assessment of a person's care needs. The social protection authority must conduct such an assessment within two days of the date of application, and within the next ten days, make a decision on the provision of such services and conclude a tripartite agreement between the service recipient, the provider, and the social protection authority. The amount of compensation depends on the person's care needs.

A provider of social services on a non-professional basis can be an adult person of legal capacity who lives with a family member in need of care, is connected to them by a common household, and they have mutual rights and obligations. The amount of compensation is calculated depending on the average monthly total income of the individual providing social services.

Each of the compensations is important for maintaining the health and independence of people in need of assistance.
