Over the past four months of work within the Rehabilitation in Ukraine (Rehab4U) project, lawyers of the National Assembly of People with Disabilities of Ukraine have reviewed 22 legal acts and provided their recommendations. In 12 cases, the NAPD experts approved these documents without any comments, provided their proposals to 6 regulations, and did not support 4 draft laws.
The Assembly's lawyers analyzed documents provided by the Verkhovna Rada Committee on Social Policy and Protection of Veterans' Rights, as well as a number of ministries: The Ministry of Health of Ukraine, the Ministry of Veterans Affairs of Ukraine, the Ministry of Justice of Ukraine, the Ministry of Social Policy, Family and Unity of Ukraine, etc. The Department of Social and Veteran Policy of the Kyiv City State Administration also sought advice from the NAIU.
In addition, on their own initiative, the NAPD specialists prepared a document in which they justified the need for systemic institutional support for public organizations of people with disabilities at the expense of the state budget in the context of martial law and post-war recovery. The proposals were sent to the Ministry of Social Policy, Family and Unity of Ukraine, as well as to the Fund for Social Protection of Persons with Disabilities.
The comments and suggestions to the legal acts provided by the NAPD lawyers concern bringing certain legislative provisions in line with the UN Convention on the Rights of Persons with Disabilities, correct wording and unconditional observance of the rights of persons with disabilities. In particular, according to the Assembly's experts, the legislative initiative that provides for the possibility of making adjustments to the conditions for granting the right to preferential travel to people with disabilities needs to be improved.
The involvement of the Assembly's experts in the development of legislative documents allows for a fuller consideration of the needs of people with disabilities in public policy and strengthens the role of NGOs as important partners of the state in humanitarian response, protection of rights and provision of assistance.
