The Fund for Social Protection of Persons with Disabilities, on the instructions of the Ministry of Social Policy, excluded rehabilitation institutions with the legal form of "individual entrepreneur" from the List of rehabilitation institutions entitled to budgetary reimbursement of the cost of rehabilitation services provided to children with disabilities.
This happened on June 27, 2024, in the middle of the budget year, without warning to rehabilitation service providers and families with children with disabilities who were counting on rehabilitation from individual entrepreneurs.
The Foundation explains the sudden exclusion of all individual entrepreneurs from the List by the fact that in October 2021, the Procedure for the use of funds provided in the state budget for the rehabilitation of children with disabilities, approved by the Resolution of the Cabinet of Ministers of Ukraine No. 309 dated 27.03.2019, was amended to the subject composition of rehabilitation service providers, namely the wording "health care institutions of any organizational and legal form" was replaced by "rehabilitation institutions".
So it took the Social Protection Fund for Persons with Disabilities 2.5 years to come to the realization that it was unlawfully financing rehabilitation for children with disabilities by individual entrepreneurs.
The Business Ombudsman Council, which was approached by rehabilitation service providers, called on the Ministry of Social Policy and the Social Protection Fund for Persons with Disabilities to take measures to eliminate discriminatory conditions in the market of rehabilitation services, the cost of which is reimbursed from the budget, and initiated a joint discussion of the problem.
The Ministry and the Fund for Social Protection of Persons with Disabilities are still silent, and children with disabilities do not receive rehabilitation services!
The NAIU shares the concern of families of children with disabilities and will fight for their right to choose a rehabilitation service provider independently, including from among individual entrepreneurs!
For reference: Four individual entrepreneurs have entered into contracts with the NHSU to provide medical packages for rehabilitation care in the healthcare sector. At the same time, the definition of "rehabilitation institution, department, unit" in Article 11 of the Law of Ukraine "On Rehabilitation in the Healthcare Sector" does not mention individual entrepreneurs. This article states that a rehabilitation institution, department, or unit is a legal entity of any form of ownership and organizational and legal form or its separate subdivision that provides rehabilitation assistance on the basis of a license to conduct business activities in medical practice, which provides for the right to provide rehabilitation in the field of health care.
