Government Resolution No. 452 of 05.05.2023 amended the Procedure for Establishing the Relationship between Disability and Injuries or Other Health Damages, approved by Resolution No. 306 of the Cabinet of Ministers of Ukraine of 25.04.2018, which illegally narrowed the list of territories where injuries or other health damages gave civilians the right to establish the status of a person with a disability as a result of war. Фактично тоді Урядом було встановлено, що статус особи з інвалідністю внаслідок війни могли отримати цивільні особи, які постраждали внаслідок поранень чи інших ушкоджень здоров’я (від вибухових речовин, боєприпасів і військового озброєння), одержаних з 24 лютого 2022 року на території, де ведуться бойові дії, та на прифронтовій території згідно з переліком, затвердженим Мінреінтеграції.
Внаслідок вищевказаних змін тисячі цивільних осіб, які проживали не в східних областях країни, отримавши поранення чи інші ушкодження здоров’я від російських ракет, замість статусу особи внаслідок війни, отримували статус особи з інвалідністю внаслідок «побутової» травми (загальне захворювання).
Національна Асамблея людей з інвалідністю в Україні з метою вирішення вищевказаної проблеми листом від 21.09.2023 № 408/1 звернулася до Віце-прем’єр-міністру – Міністру з питань реінтеграції тимчасово окупованих територій України ВЕРЕЩУК І. А., Офісу Президента України та Комітету Верховної Ради України з питань соціальної політики та захисту прав ветеранів.
Надалі ще була тривала адвокаційна кампанія НАІУ з цього приводу.
Проблема була врегульована постановою Кабінету Міністрів України від 15.10.2024 № 1186.

Advocacy in Action: The Rights of Civilians Affected by War
By Government Resolution No. 452 of 05.05.2023, amendments were made to the Procedure for Establishing the Connection of Disability with Injuries or Other Health Damage, approved by Cabinet of Ministers Resolution No. 306 of 25.04.2018. These amendments unlawfully restricted the list of territories where injuries or other health damage would grant civilians the right to obtain the status of a person with a disability due to war.
At that time, the government ruled that only civilians who suffered injuries or other health damage (from explosive substances, ammunition, and military weapons) on or after February 24, 2022, in combat zones or frontline areas, as determined by the Ministry of Reintegration, could be granted disability status due to war.
As a result of these changes, thousands of civilians living outside the eastern regions of Ukraine who sustained injuries from Russian missile attacks were denied the status of a person with a disability due to war. Instead, they were classified as having a “household” injury (a general illness).
To address this issue, the National Assembly of People with Disabilities of Ukraine (NAPD) sent an official letter (No. 408/1, dated 21.09.2023) to the Vice Prime Minister – Minister for Reintegration of the Temporarily Occupied Territories of Ukraine Iryna Vereshchuk, the Office of the President of Ukraine, and the Parliamentary Committee on Social Policy and Veterans’ Rights.
This was followed by an extensive advocacy campaign led by NAPD on the issue.
Thanks to these efforts, the problem was resolved through Cabinet of Ministers Resolution No. 1186, adopted on 15.10.2024.
