On the procedure for establishing a diagnosis of mental disorders for young children

The issue of establishing a disability in general and the diagnosis of mental disorders in particular is becoming more and more relevant every day.

As for the relevant diagnosis, the following should be noted.

According to part three of Article 7 The Law of Ukraine "On Psychiatric Care" prohibits determining the state of mental health of a person and establishing a diagnosis of mental disorders without a psychiatric examination of the person, except in cases of posthumous forensic psychiatric examination.

According to part two of Article 11 of the said Law, a psychiatric examination of a person under the age of 14 (a minor) is carried out by a psychiatrist at the request or with the written consent of his or her parents or other legal representative. In case of disagreement of one of the parents or in the absence of parents, psychiatric examination of a person under the age of 14 (minor) is carried out by decision (consent) of the guardianship and custody authority.

In turn, the Order of the Ministry of Health of Ukraine No. 970 of September 15, 2016 approved form of primary accounting documentation No. 003-11/о "Informed consent of a parent or other legal representative to a psychiatric examination of a person under the age of 14 (a minor)" and instructions for filling it out.

In accordance with the above instruction, form No. 003-11/о is filled in by the child's parents or other legal representative who have applied to the health care facility and give consent to a psychiatric examination of a person under the age of 14 (minor). This is carried out in the presence of a doctor of this health care facility. The child's parents or other legal representative personally indicate their surname, name, patronymic and the child's surname, name, patronymic; the doctor provides information about the diagnostic plan, provides information in an accessible form about the patient's rights and the doctor's responsibilities. Consent to psychiatric examination of a person under the age of 14 (minor) is certified by the signatures of the doctor and the child's parents or other legal representative, indicating the date (day, month, year).
